DAL COTONE LLC – STANDARD TERMS AND CONDITIONS OF SALE
1. Payment Terms
Invoices must be paid by the due date specified on the invoice. Applicable sales tax will be added to the invoice and is the responsibility of the client.
2. Late Payments
If payment is not received by the due date, a late fee of 1.5% per month (18% per year) or a minimum charge of $25 will apply. Dal Cotone LLC reserves the right to suspend future deliveries until the account is settled.
3. Debt Collection & Credit Reporting
Accounts not paid within 7 days past the due date may be referred to a collections agency. All recovery costs, including attorney’s fees, will be charged to the client. The client acknowledges that unpaid debts may be reported to credit bureaus or public records, to the extent permitted by law.
4. Ownership of Goods
Title and ownership of all goods shall remain with Dal Cotone LLC until full payment of the invoice has been received. Dal Cotone LLC reserves the right to reclaim products in the event of non-payment.
5. Risk of Loss & Acceptance
The risk of loss or damage to the goods passes to the client upon delivery and signature of the invoice. By signing the invoice, the client acknowledges correct receipt of the goods and full acceptance of these Terms and Conditions.
6. Product Returns & Claims
All claims for missing or defective products must be submitted in writing within 7 days of delivery.
7. Limitation of Liability
Dal Cotone LLC’s liability is strictly limited to the replacement of defective products. Dal Cotone LLC shall not be held liable for any indirect, incidental, or consequential damages, including claims made by the client’s end customers.
8. Termination of Account
Dal Cotone LLC reserves the right to suspend or terminate future sales and deliveries to any client who fails to comply with these Terms and Conditions or whose account remains unpaid.
9. Governing Law & Jurisdiction
All sales are governed by the laws of the State of Florida, USA. Any dispute shall be submitted exclusively to the courts of Orange County, Florida.
DAL COTONE LLC – RETURN POLICY
1. Final Sale
All sales are final. Returns will only be accepted in the case of defective or incorrectly delivered products.
2. Eligibility for Returns
- Claims must be made within 7 days of delivery.
- Products must be unused, unopened, and in their original packaging.
- Used or opened products cannot be returned under any circumstances due to health, safety, and sanitary regulations.
This policy is in place to protect both our customers and end consumers, as once a cosmetic product has been opened, Dal Cotone LLC can no longer guarantee its safety, quality, or integrity.
3. Return Process
To request a return, the client must submit a written claim to Dal Cotone LLC within the 7-day period. Claims must include the invoice number, description of the product, and reason for the return.
4. Resolution
Approved returns will be handled at Dal Cotone LLC’s discretion as either:
- Replacement of the product, or
- Credit applied to the client’s account for future purchases.
Cash refunds are not offered.
5. Responsibility
Dal Cotone LLC is not responsible for damages caused by improper use, storage, or application of products. Liability is strictly limited to the replacement of defective items.
